When I lived in Red Deer, Ab I was involved in an accident; I was clearing an intersection on a yellow light. Since the weather was horrible that day it seemed like the driver coming through the intersection didn’t want to stop, and T-boned the front end of my vehicle.
We have both filed a police report already and I lost my vehicle because I didn’t have collision on my insurance policy, my insurance rate also went up because I should have yielded to oncoming traffic. It has been four months since the incident and I’ve moved to Calgary.
Just today the RCMP phoned me and told me that I need to appear in court because the driver that hit me is being charged for reckless driving.
QUESTION: If he is charged guilty, does that mean I’m not longer liable for the accident? Also, should AMA lower my insurance rate to what it was before the accident and does his insurance company have to replace my vehicle since he is guilty?
