can i directly go after the insurance company of the person who hit my car since mine won’t pay?

student driver hit my car—the owner/operator/instructor of driving school was sitting in their passenger seat. They were at 100% fault. My insurance pay coz I don’t have COLLISION COVERAGE. I live in Ontario. Can I go after their insurance company ? By this I do not mean sue in small claims court. I have witnesses on my side.
The owner/instructor of driving school has coverage and did not leave the scene. My car is older with A LOT of miles, but in excellent condition with frequent maintenance and upkeep. please help. Is there anything in my favour since it was a “business” that wrecked my car, not a “personal” vehicle?
that is Ontario, Canada, btw.
Also is the student driver liable in anyway? Do I go after their coverage or just the school operator?? I don’t know if the student even has coverage or a license?

  1. If it were 100% the fault of others there is no reason your insurance should cover !!!!!!!!!!! Do not let them screw !!!!!!!!!!!!

  2. Talk to your landlord, talk with your insurance company and talk to a lawyer. I do not know if it would be different in Ontario than in the U.S., but the lawyer will ensure that you win and get the best possible solution for which he / she also receives a salaire.Cela words, if your car is very old and you’re not hurt, do not expect much of this règlement.Ne get a lawyer as soon as possible. Ask a family member or friend to recommend one if pouvez.Bonne luck!

  3. Yes, you can file a complaint with the owner of the insurance company. They accept the responsibility that cover their damages and rent a while the car is in the magasin.À this stage, you do not need a lawyer who does not suck your wallet dry. If you are injured, most lawyers do not represent any façon.Non, you can not pick up the student. Unless the coverage limits are insufficient owners, which I doubt they will.

  4. Of course, you can and should file a complaint with the pilot school. Business or personal. It makes no difference. But. . . . . Since insurance companies are the ones who determine the “guilt” that pays for repairs, how do you know that they were “responsible for 100%”? Also. . . Forget about the practice of law in place. Failure to do the right thing and later and will cost you money.

  5. If another vehicle is responsible for 100%, then you do not need collision coverage, because coverage of the collision is used when the accident is your fault (which is also used in hit and run situations and situations in which the other party not admit fault at a time, but this is not the case here). So if your insurance company says the claim is payable under the collision coverage when they say that is at fault, or the claim will be paid in compensation section of direct damage to its policy, all policies auto insurance coverage with the road in Ontario (it is a compulsory insurance). You can not file a claim on the insurance of the other vehicle (your insurance company tell only find coverage in your policy.) You need to file a complaint, but if you own insurance company says you’re wrong (and have years of experience in the determination of guilt), then the chances of finding a judge who will side remotely.

  6. Ontario Insurance is good to have not. So many people are unsure, do not pay. Sorry, but try to win, and try beureau business better.
