I got into rear Ended and the Calfornia Highway Patrol blamed me in the report that I caused the traffic collision in a violation of California Vehicle Code section 21658(a) VC- Unsafe lane change. I believe it was not at all my fault and the other party gave a wrong statement. What can I do in this case. Will my insurance go up???

Well I agree what linlyons said… but in the report it said that the other party (she) looked down to turn down her radio and looked up again and I was entering in the lane #5 in front of her which didn’t giver her time to react… so now what do you say in that regards…

Go to court and contest the ticket. Yes, your insurance will go up about 10% if the ticket is not dismissed. You are to make a signal at least 200 feet before making a lane change. Did you?

It depends on your insurance, and you’ll have a hard time fighting this in court. While mistakes happen, unfortunately for you the Highway Patrol is reporting against you. That means that you will have to prove without a shadow of a doubt that you did NOT cause that accident.

In some states it doesn’t matter who is at fault; the person who hits is always the one to get the ticket.
It was not your fault at all. the person that hit you pushed you causing the “unsafe lane change.” you can definetly fight this one in court. I’m not sure if your insurance will go up
if you’re entering the freeway, it’s your responsibility to make sure that it’s safe.

it would not be unreasonable for your insurance company to decide that you’re a greater risk, because you refuse to take responsibility for an accident you caused, and would be likely to do the same in the future, and your rates should be adjusted upward appropriately, or your insurance should be canceled.
